1. Introduction & Acceptance
Welcome to Pimplum. These Terms of Service ("Terms") govern your access to and use of the Pimplum platform, website, and mobile applications (collectively, the "Platform"), operated by Pimplum ("we," "us," or "our"). The Platform connects users seeking local services (such as beauty services, pet grooming, home cleaning, plumbing, and similar services) with independent service providers in Lithuania and the European Union.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform. We recommend that you read these Terms carefully before using our services.
2. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into a binding contract to use the Platform. By using Pimplum, you represent and warrant that you meet these eligibility requirements.
The Platform is intended for use by residents of Lithuania and the European Union. If you access the Platform from outside these regions, you do so at your own risk and are responsible for compliance with local laws.
3. Account Registration
To access certain features of the Platform, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
4. Services & Marketplace
Pimplum operates as a marketplace platform that facilitates connections between users and independent service providers. We do not employ, endorse, or guarantee any service provider. Each service provider is an independent business or individual, and the actual service agreement is between you and the service provider.
We do not provide the services listed on the Platform. We are not responsible for the quality, safety, legality, or timeliness of services provided by third parties. Any disputes regarding services must be resolved directly between you and the service provider, subject to these Terms and applicable law.
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice.
5. Bookings & Payments
When you book a service through the Platform, you enter into a direct agreement with the service provider. Payment terms, including pricing, deposit requirements, and payment methods, are determined by the service provider and displayed at the time of booking.
You agree to pay all fees associated with your bookings in accordance with the payment terms presented. All prices are displayed in Euros (EUR) unless otherwise indicated. Prices may include applicable taxes where required by law.
Pimplum may facilitate payment processing but is not responsible for the collection or remittance of funds between users and service providers. Any payment disputes should be addressed to the service provider or our support team as appropriate.
6. Cancellations & Refunds
Cancellation and refund policies are set by individual service providers and may vary. You should review the cancellation policy displayed at the time of booking before confirming your reservation.
In general, cancellations made within the timeframe specified by the service provider may be eligible for a full or partial refund. Late cancellations or no-shows may result in forfeiture of deposits or full payment. We encourage you to contact the service provider directly for cancellation requests.
Pimplum does not guarantee refunds. Refund eligibility is determined by the service provider's policy and applicable consumer protection laws in your jurisdiction.
7. User Conduct
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Post false, misleading, or fraudulent content
- Harass, abuse, or harm other users or service providers
- Attempt to circumvent the Platform to conduct transactions offline
- Use the Platform for any commercial purpose not expressly permitted
- Interfere with or disrupt the Platform or its infrastructure
We reserve the right to suspend or terminate your account and access to the Platform if we determine, in our sole discretion, that you have violated these Terms or engaged in conduct harmful to the Platform or its users.
8. Intellectual Property
The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by Pimplum, its licensors, or other providers of such material and are protected by European Union and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our material without our prior written consent, except as necessary to view the content for your personal, non-commercial use.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Pimplum and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Platform
- Any conduct or content of any third party on the Platform
- Any content obtained from the Platform
- Unauthorized access, use, or alteration of your transmissions or content
Our total liability for any claims arising from or related to these Terms or the Platform shall not exceed the amount you paid to Pimplum (if any) in the twelve (12) months preceding the claim, or one hundred Euros (€100), whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Pimplum and its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys' fees) arising from: (a) your use of and access to the Platform; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Platform caused damage to a third party.
11. Termination
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Platform will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
You may terminate your account at any time by contacting us or through your account settings, subject to any outstanding obligations you may have.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. If you are a consumer residing in the European Union, you may also benefit from mandatory consumer protection provisions of the law of your country of residence.
13. Dispute Resolution
For any dispute arising from these Terms or the Platform, we encourage you to contact us first to seek an informal resolution. You may reach us at legal@pimplum.com.
If a dispute cannot be resolved informally, it shall be submitted to the courts of the Republic of Lithuania, which shall have exclusive jurisdiction. If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence in accordance with applicable consumer protection laws.
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution procedures but may do so at our discretion.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on the Platform and updating the "Last updated" date.
Your continued use of the Platform after any changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Platform. We encourage you to review these Terms periodically.
